Brcko Supervisor Regulates Status of Additional Floors In Brcko District

Brcko Supervisor Henry L. Clarke today issued an Order requesting the Government to inspect and regulate the status of additional floors constructed since 1999 on publicly owned buildings in the Brcko District.

As the apartment privatization process starts, it is important to ensure that owners of Apartments built within additional floors have exactly the same rights and obligations as any other owner of an apartment in the same building. In order to achieve this, both categories of apartments need to meet the same legal and construction standards.

The Order rescinds the obsolete pre-war law on additional construction as well as earlier decisions of the Executive Board of the former RS Brcko Municipality and the Brcko District Assembly relating to conditions, procedure, and requirements for constructing additional floors.

Within forty five days from the day of issuance of the Order, the Brcko District Government is to conduct a thorough inspection of all additional floors in the District to determine whether these constructions have all the legal permits, and whether they are built in accordance with the mandatory technical regulations and safety standards. Inspection should also ensure that these constructions are properly connected to utilities and meters. In case of additional floors not meeting prescribed requirements, the inspection will ensure that the responsibility and obligations of the Contractor are identified, and corrective action must be taken. 

Ownership of each apartment should be registered with the Court, but only after it meets the necessary standards.

All ongoing construction of additional floors will be stopped immediately until the inspection is conducted, and all the actions resulting from it are taken.

The Supervisor wants to ensure that all apartments in Brcko are in compliance with safety standards, and that the owners can participate fairly in maintaining of buildings.
