BiH HoR condemns flags torching, discusses OSA work

 

 

 

 

 

BH Radio 1 by Mustafa Karahmet – BiH House of Representatives condemned burning down of flags during Sarajevo protests held in front of the Danish, Norwegian, French and Croatian Embassies over caricatures of Prophet Mohammed. MPs also discussed the report on activities of the BiH Intelligence Agency (OSA) for 2004, firstly focusing on whether or not to debate report publicly or behind the closed doors. After adoption of the latter option, several MPs from the opposition announced to boycott of agenda item and MP Tihomir Gligoric asked for a recess in order to find clear interpretation of Law on OSA. MPs should also discuss the proposal for budget for 2006, which is proposed in amount of KM954, 5 million. Beside this, BiH HoR would also discuss two proposals of amendments to Law on VAT, which refer to more favorable treatment of basic food products and publishing sector. RHB also reported. 

FBiH HoP discusses two proposals of public revenues distribution

 

BH Radio 1 by Ljiljana Radl – FBiH House of Peoples is in session discussing two proposals of the Law on distribution of public revenues, proponents of which are FBiH Government and MP Svetozar Pudaric. According to first proposal, the distribution should go form Entity to the Cantons, and then indirectly to municipalities. Second proposal proposes directs distribution to the Federation and separately to the Cantons and Municipalities.

BiH CoM Chairman Terzic to discuss economic relations with Croatian PM Sander in Zagreb today

RHB– Croatian Government’s spokesperson Ratko Macek confirmed that BiH CoM Chairman Adnan Terzic should pay an unofficial visit to Zagreb today where he would meet with Croatian PM Ivo Sanader. RHB says that it has been expected that they would discuss economic relations. According to unofficial information, Terzic is going to attend a play ‘Hamlet’ by BiH Director Haris Pasovic which plays in Zagreb this week.

US Undersecretary for Political Issues Burns: Time for const. changes in BiH has come

RHB– US Undersecretary for Political Issues Nicholas Burns stated for Voice of America that hebelieves that 10 years after Dayton the time has come for true changes of the BiH Constitution and that the USA suggests to political leaders to dedicate to constitutional changes, to agree to have 1 President, strengthen powers of the Prime Minister and create a more efficient Parliament.

BHT1– The HR Christian Schwarz-Schilling stated in Brussels on Monday he has no intention to intervene in the reforms processes in BiH, but to assist them. Schwarz-Schilling met with the NATO Secretary-General Jaap de Hoop Scheffer and EU Commissioner for Enlargement Olli Rehn to talk about the priorities during his mandate, which include supporting BiH’s progress towards the EU and NATO.HR emphasised that ICTY cooperation must be completed by extradition of all war crime indictees. “In case of BIH, more improvement was made regarding the ICTY cooperation than in the case of SiCG. Therefore, BIH must maintain the rhythm and the communication with Brussels would not be suspended,” underlined CSS. In this light, he stressed he would use his Bonn powers “to support the Tribunal”. Schwarz-Schilling expressed satisfaction upon hearing that EC has assessed the preparation work of the BIH negotiating team at the first round of talks on Stabilisation and Association Agreement as remarkable. BHT 1 notes that an emphasize was put on the necessity to continue police and defence reforms with determination/ commitment of the BIH authorities. The very fist HR Carl Bildt was in Brussels at the same time with Schwarz-Schilling. “The circle is completed. It should have happened before but it took time to arrange things in BIH. I believe that everything apart from economy in BIH is progressing well,” stated Bildt. Reporter concludes that that a “coincidence” of having the first and the last High Representative in Brussels at the same time indicates IC is ready to “close the circle in BIH”. PINK– Schwarz-Schilling expressed hope that BiH would be able to complete the SAA negotiations with the EU within one year. Schwarz-Schilling and Rehn agreed that the success of SAA talks depends on the ability of the BiH authorities to implement the necessary reforms. BiH Minister of Foreign Affairs Ivanic to ask for US support to accession of BiH to PfP

 

BHT1– BiH Foreign Affairs Minister Mladen Ivanic attended the meeting of American-Adriatic Charter in Washington. BiH is taking part in the meeting of American-Adriatic Charter signatory states as an observer, as is Serbia-Montenegro. Ivanic will request the US to support BiH accession to the NATO’s Partnership for Peace program as soon as possible. DL: Bozo Ljubic will form new party in next 10 days or so

 

Dnevni List, pg 3 ‘New Croat party being established’, by Ivica Glibusic – Despite numerous reports in Monday media that suggested that a former/expelled member of HDZ, Bozo Ljubic, is having second thoughts about establishment of a new Croat party in BiH, according to DL’s information expelled members of HDZ led by Ljubic have completed all preparations to form a new political party that would happen in the next 10 days or so. Apparently, the backbone of the party will be formed by expelled members of the HDZ, however prominent economists and intellectuals as well as smaller Croat parties that could have problems with passing the election threshold could be joining the new party. The party allegedly has a strong support of the Croatian PM, Ivo Sanader, and is also being supported by some international circles in BiH.

BiH HoR Commission rejectes SDS’ Novakovic’s proposal of law on higher education, Ceman (SDA) wants BiH CoM to get engaged

 

Dnevni List, pg 3 ‘Only Council of Ministers can end the meaninglessness’, by D. P. Mandic – The Commission of Constitution-Legal issues of the BiH HoR rejected the proposal of law on higher education the proponent of which was Momcilo Novakovic (SDS, MP). Chairman of the Commission, Mirsad Ceman (SDA), explains this is the third or fourth time the Commission has rejected Novakovic’s proposal, however the BiH HoR did not adopt the Commission’s report on a single occasion. VL: RS has become bigger than FBiH; Grahovo, Drvar, Glamoc planning to separate from FBiH and join RS

 

Vecernji List, front pg splash and pgs 6-7 ‘Federation has become smaller than RS’, by Zdenko Jurilj – According to VL, it is the FBIH that could and should be labelled ‘the smaller BiH entity’, the term often used to describe the RS. Namely, VL claims given that the municipal authorities in Drvar, Bosansko Grahovo and Glamoc (in the FBiH) are in hands of ‘Serb’ parties, who are taking autonomous decisions irrespective of decisions and instructions of cantonal and FBiH authorities, one can says that Banja Luka has more influence than Sarajevo when it comes to these municipalities and that, effectively, the RS covers 52% of BiH territory. VL also says that the municipalities want to separate from the FBiH and join the RS, the plan that is particularly supported by the PDP and SDS.

DL Interview with SDP’s Lagumdzija: Schwarz-Schilling came to help BiH, Ashdown used BiH as ‘springboard’

 

Dnevni List, pgs 8-9 ‘Corruption is shield and weapons used by criminals’, by Resad Dautefendic – In an interview to daily, the SDP leader Zlatko Lagumdzija was also asked to make a comparison between the current and former HR, Christian Schwarz-Schilling and Paddy Ashdown that is. Lagumdzija argues that the current HR has come to BiH to help the country and make it a self-sustainable state, whilst the former HR used BiH as ‘a springboard for something else’. On Ashdown, Lagumdzija stated: “(…) He believed the crime and corruption were the only problem of the country, I believed the crime and corruption were shield and weapons war criminals and nationalists are using to defend themselves”.

Oslobodjenje op-ed ‘Citizen block’ op-ed by Mirko Sagolj – Editorial reads that establishment of new BiH political party – Movement for Changes [PzP], would be a good move if that would strengthen ‘civic block’, as announced by PzP leader Sahbaz Dzihanovic (former SBiH high official). Author warns that the new party would do nothing if its competition would be SDP or other parties with similar orientation.

DA op-ed: If Croatia really want to help BiH in Euro-Atlantic integrations, it should start respecting international agreements

 

Dnevni Avaz pg 3 ‘Sanader’s story with no ground’ by Husein Orahovac – Commenting recent statement of Croatian Prime Minister Ivo Sanader that “official Zagreb would continue to support BiH Euro-Atlantic integrations”, editorial reads that so far, there have been no actual support from official Zagreb to BiH. Author further says that it is completely opposite, since two neighbouring countries have lot of crucial issues unsolved, among them agreements on borders and dual citizenship. Editorial concludes that if Croatia really wants to help BiH, than it should not build ‘PeljesacBridge’, and it should respect international agreement on ‘PloceHarbour’.

Vjesnik: Sanader for well organized BiH in order to have prosperous region

 

Vjesnik, pg 15 ‘Recipe for Bosnia’, by Jurica Kobler – Commenting on the visit of the Croatian PM, Ivo Sanader, to BiH from last Saturday, Kobler says Sanader cleared all the vagueness related to attitude of Croatia towards BiH when Sanader stated that BiH should be home to three equal peoples and that the Croats in BiH should be the ones who should be having a clear vision how to achieve such goal. According to Kobler, such concise position of the Croatian PM was a pleasant surprise even for the new HR, Christian Schwarz-Schilling. As a conclusion, Kobler notes that Sanader knows too well that BiH has to be set up well because only a peaceful BiH would bring prosperity to the region. RS PM-designate Dodik demands RSNA session to discuss new RS Government

 

 

 

 

RTRS – RS Prime Minister designate Milorad Dodik submitted request to the RS National Assembly Speaker Dusan Stojicic to schedule RSNA session with an aim to discuss new RS Government. Session would probably be scheduled for February 27 since OHR needs time to conduct vetting procedure on candidates for ministerial positions. Dodik announced that RS would get its budget as soon as new Government is cleared and added that RSNA will get a new Speaker, Igor Radojicic. He stressed that the new Government will enter fierce fight against organised crime. Dodik also intends to audit privatisation process in RS. Reporter comments that the new Government will be made of 7 SNSD Ministers, 3 PDP ones, 2 each from SDP and SzBIH, 1 each from SDA and DNS whilst SP RS candidate will also fill 1 place. Diklic– Commenting the appointment of the new RS Government, SNSD leader and RS PM- designate Milorad Dodik stated that OHR vetting procedure would be finished by February 27 and he expects that all names would be approved. Dodik announced that immediately after the establishment of the RS Government, he would ask for abolishment of OHR vetting procedure, since he sees this as direct interference into democracy. “I have sent one candidate to the OHR for the position of RS Interior Minister and I am convinced that there will be no problems” said Dodik.

HJPC: BiH judiciary is politically independent, but inefficient due to world load

 

 

 

 

 

 

PINK – BiH High Judicial and Prosecutorial Council (HJPC) claims that BIH judiciary is independent from the political influence. On Monday, HJPC launched the three-months public information campaign ‘Independent and effective judiciary for BiH’ with an aim to make public aware of all aspects of judicial reform, and to open dialogue with the participants in this reform process. During the campaign, HJPC wants to point out the fact that the successful judicial reform is one of the prerequisites for BiH’s admission into EU. BHT 1 – Reporter comments that a problem for BIH judicial system is inefficiency caused by approximately million uncompleted cases. Chairman of HJCP Branko Peric stated that the system suffers enormous pressure to solve all the cases, which is impossible. In order to solve these issues, HJCP suggests better use of mediation as a process of reaching out-of-court settlement. EC has warned BIH Judiciary to finish the old cases. Graffiti in Ilidza, Sarajevo insulting Serbs

RS MoI: RS MoI Matijasevic received threats in the past as well

 

Oslobodjenje pg 2 ‘Matijasevic received threats in the past as well’ by Fena –RS Interior Ministry spokesperson Radovan Pejic confirmed that all measures defined by law have been undertaken, following the latest threat letter sent to outgoing RS Minister Darko Matijasevic. Pejic said that the threat letter titled “Farewell Salutation to Minister Matijasevic” is nothing new for the police because similar threats have been made in the past as well. DA learns that almost all RS as well as FBiH officials have been receiving threats.

SIPA raids CRA ’s premises; FTV: PDP behind “this politically orchestrated action”

 

FTV by Zvonko Maric – In the past 48 days, SIPA has been reaching extensive investigation in the premises of the Communications Regulatory Agency. According to FTV, SIPA has been doing so not because of the criminal charges filed, but upon the order of BiH Deputy Prosecutor Biljana Simeunovic. Reporter stresses “to make it even more paradoxical, the motive of the investigation is a positive report on CRA work from audit conducted by the BIH Audit Agency.” Reporter further comments that “it is rather difficult to explain the determination and eagerness of SIPA” inspectors who allegedly search through documents from 2004 and even 1998. FTV’s well-informed sources say this is politically orchestrated action against CRA independence carried out by PDP officials, in which case as FTV journalist concludes, “independent media would be lost”. FTV further learns that leaders of this action are BIH Communications Minister Branko Dokic and his advisor Zdravko Savija, who always supported the idea of entity CRAs.  FTV further speculates that SIPA Director Sredoje Novic was influenced by PDP, as Mladen Ivanic allegedly helped Novic’s appointment. FTV also claims that Simeunovic is former Ivanic’s secretary, thus “it is obvious that PDP is a key factor in the SIPA raid action in CRA out of revenge”. BHT1: ICTY Chief Prosecutor submitted new cases to BiH judiciary

 

BHT 1– As BHT1 learns, The Chief ICTY Prosecutor Carla Del Ponte, during her visit to BiH has submitted new war crime cases to BiH Judiciary. The submitted cases refer to war crimes in Podrinje, Mid-Bosnia, wider region of Sarajevo and Herzegovina. Reporter noted that although ICTY filed more than 160 indictments there lot of unfinished investigations. Amir Ahmic, ICTY Liaison officer, stated that the ICTY exit strategy is based on transferring the cases to the local judiciary. “This is one of the reasons why many investigations haven’t been finished. Other reasons for having the unfinished investigations are related to the insufficient funds or lack of evidence. ICTY also was compelled by the UN decision from 2003 to file charges only against high military or governmental officials” explained Ahmic. Reporter noted that many BIH Court prosecutors have been transferred from ICTY because of the exit strategy adding that the national and international experts have monitored the entire process. Nerma Jelacic, from Balkan Investigation Network, stated that OSCE, as one of the international organisations, monitors the transfer process while national organisations monitor the implementation of the transfer. ICTY will also transfer all evidence material collected in last 13 years.

Tomic also claims all three members of the family were shot from behind.

FBiH House of Peoples to discuss Law on distribution of public revenues: support to GAP ’s proposal uncertain

 

 

 

 

Hayat – FBiH House of Peoples (HoP) should discuss on Tuesday two proposed laws on the distribution of public revenues: one made by FBiH Government – which FBiH House of Representatives already rejected, and another one proposed by USAID-funded project, Civic Alternative Parliament (GAP). GAP proposed completely new way of the distribution of funds from the Indirect Taxation Administration (ITA) account. According to FBiH Government’s proposal, the system of allocation of public revenues would remain the same: funds would be transferred to FBiH’s account and FBiH would have to distribute them to the lower levels of authority, explained FBiH HoP Secretary Izmir Hadziavdic. Anyway, according to Hayat reporter, municipalities will be discontented, because they would not receive enough money. FTV–  According to the FBIH Government’s draft law, the public revenues are distributed to the municipalities through cantons while according to the second draft law, the public revenues are directly distributed from FBIH level to the municipalities. OSCE on Monday publicly supported the second proposal. Supporters of the GAP proposal claim that Government’s proposal will allow misuse of the assets especially in the election years.

Mostar Major Beslic supports FBiH Government’s proposal of law on distribution of revenues

 

FTV, Oslobodjenje pg 6 ‘Support to Law on public revenues’, Vecernji List pg 4 ‘Beslic against GAP’s proposal on distribution of money!’ by zk – Mostar Mayor Ljubo Beslic sent a letter to FBIH Deputy Prime Minister Dragan Vrankic, Chairman of FBIH House of Peoples Slavko Matic and Chairman of FBIH House of Representatives Muhamed Ibrahimovic in which he expressed support to the FBIH Government’s draft law on distribution of public revenue, stressing that the proposal of GAP would bring Mostar into even more difficult financial situation. He added that the GAP’s proposal is completely unacceptable at the moment since a part of tax incomes that Mostar would get would not be only considerably less than the current one but it would also keep reducing in the next 5 years. Beslic also reminded in the letter that on the ground of the OHR’s decision Mostar has been deprived of 8 millions KM that it used to receive from 2 Elektroprivredas. 

BiH Foreign Affair Minister Ivanic: EU sent a clear message by proposing the establishment of free trade zone

 

PINK– During the meeting with Croatian Prime Minister Ivo Sanader on Saturday evening in Mostar, High Representative in BiH Christian Schwarz-Schillingsupported Sanader’s proposal that all five South-eastern European countries should be included in the Central European Free Trade Agreement (CEFTA). The official stance of BiH authorities, according to PINK reporter, is that such initiative would improve the economic relations in region, and represent a good preparation for the admission to European Union. According to BiH Minister of Foreign Affairs Mladen Ivanic, by suggesting that the Balkan free trade zone should be established, European Union has sent a clear message to the region: ‘If you are not able to cooperate mutually, how you would cooperate with us?’ Therefore, BiH fully supports this initiative: “Since we all have mutual bilateral agreements, the free trade zone is practically already established; it only needs to be formalized”, explained Ivanic. He added that the subsidies to agricultural workers would have to be increased in case free trade zone is officially established. “If we remove (import) duties without subsidies to our farmers, the agriculture in BiH and RS would be practically completely destroyed”, concluded Ivanic.

‘Aluminij’ Director Brajkovic in FTV’s 60 minuta: We are willing to employ non-Croats, but only Croats apply to vacancies

 

FTV current affair program ’60 Minuta’ By Zvonko Maric – During the last week’s visit of FBiH Government’s delegation and FBiH Prime Minister Ahmet Hadzipasic to Mostar based company ‘Aluminji’, the issue of non-Croat employees was a matter of discussion. FTV says Bosniak and Serb workers were all “illegally” dismissed and claims they have not yet been allowed to return to work. Speaking for magazine, ‘Aluminij’ Director Mijo Brajkovic stated that this is the political issue, stressing that all employees would be compensated after the privatization process is ended. Brajkovic also added that they, as a company, are willing to employ non-Croats, but that only Croat are applying to vacancies in this company. Hadzipasic stated that the joint investment of “Aluminij” and “Feal” form Siroki Brijeg that would open about 100 new jobs, adding this would be a great opportunity for “Aluminij” to hire non-Croats as well.

Nezavisne Novine op-ed pg 7 ‘Restitution’ by Natasa Krsman – With regard to the issue of restitution, the author notes the High Representative has helped private land owners with the Law on construction land, however, according to the author, numerous court disputes of individuals versus municipalities are proof of loop holes in this Law. The author concludes by saying that in case a natural restitution, as CoM Commission foresees, is conducted, many officials and businessmen would lose their luxury apartments.

VL: US administration decides to complete first part of constitutional talks; group of European Parliament’s MPs to say BiH cannot join EU with 2 entities

Vecernji List, pgs 6-7 ‘Negotiations on Constitutions continue’, by zk – According to VL, the US administration has decided to complete the first part of constitutional reforms in BiH. Unofficially, continuation of talks could resume on this coming Thursday or Friday, however the US Ambassador to BiH, Douglas McElhaney, is yet to send invitations to the parties’ leaders. VL also learns from ‘a source in the European parliament’ that a group of MPs (in the said Parliament) will publish a ‘Promemoria’ (Document), in which they will ask for thorough changes in the country. Apparently, they will say that the country divided in the two entities cannot count on joining the EU.

Some parties are more, and some are less in favor of continuations of talks, but none is against it,” said Tihic, who didn’t want to comment his meeting with SNSD leader Milorad Dodik held in Doboj. Stressing the need for talks to be continued, Tihic also said: “If we don’t make deal now, that we have lost previous four years, since the elections would be held following ‘old’ Constitution.” EuroBlic RSpg 3 ‘Talks on Constitution in stalemate position’ by N.BreberinaMirsad Ceman (SDA) reiterated SDA’ stance urging continuation of talks, while Mladen Bosic (SDS) underlined “if anybody has some new idea, we are ready to consider it and to see whether it is acceptable for us.” Slobodan Nagradic of PDP is of the view that the negotiations on the issue are completed for the time being, adding that the solutions reached should be sent in the parliamentary procedure. DL Interview with SDP ’s Lagumdzija: PDP and SBiH guilty for interruption of constitutional reform talks

 

Dnevni List, pgs 8-9 ‘Corruption is shield and weapons used by criminals’, by Resad Dautefendic – carries an interview with the SDP President, Zlatko Lagumdzija, in which he mostly comments on the issue of constitutional changes talks. Apart from reiterating the background of the talks, Lagumdzija pointed out that the participants of the talks were close to reaching an agreement on several issues, however everything ‘broke’ on small details during the last night of negotiations. “Enter people who wanted to play political games, I mean the PDP and SBIH. They are the main culprits there was no agreement”, said Lagumdzija.

DL: HSP Djapic-Jurisic and SBIH agree – FBiH should be abolished that would lead to abolishment of RS

 

Dnevni List, pg 4, mentioned on front ‘Abolishment of Federation secretly agreed’, by Mensud Zorlak – Following a session of Presidency HSP Djapic-Jurisic, which took place in Sarajevo on Monday, DL learned that the HSP Djapic-Jurisic President, Zvonko Jurisic, and leader of SBIH, Safet Halilovic, agreed during a recently held secret meeting that the FBIH should be abolished (this information was picked up by media a while ago). The idea should enable abolishment of the RS. According to Jurisic, the initiative is being support by some other Bosniak parties “because they are aware that the existence of the RS would be meaningless if the FBIH were abolished”. Jurisic suggests that the FBIH transfers part of its responsibilities onto the State level, and part of responsibilities onto cantons.

HSP ’s Djapic: Croats to be equal when entities abolished

 

Slobodna Dalmacija, pg 6 ‘Cardinal Puljic and Djapic on Croat people in BiH’, by HZvonik Jurisic and leader of HSP of Croatia, Anto Djapic, met with Cardinal Vinko Puljic in Sarajevo on Monday to discuss the position of the BiH Croats. Djapic stressed that the pre-requisite for the Croats’ equality in BiH is the abolishment of the FBiH and RS.
